State Engineer Accused of Conflict of Interest

When New Mexico's top water official argued in April for a billion-dollar water project to benefit Navajos who have no running water, he cited a public television documentary in support of his argument. "The reality faced by many Navajo families today and the benefits of the settlement agreement were highlighted in a recent PBS documentary, 'The Water Haulers,' and many New Mexicans were shocked to realize the primitive conditions some of their neighbors are faced with," state engineer John D'Antonio wrote in an April 8 opinion piece published in the Albuquerque Journal.

What D'Antonio didn't say was that his agency helped pay for the documentary.

"How convenient," said Steve Cone, an opponent of the water project who has been critical of the state engineer's involvement.

Yesterday, in an email (see below) to David Campbell, Aquatic Ecosystems Branch Chief for the United States Fish and Wildlife Service New Mexico Ecological Services Field Office, you requested that the following item be placed on the agenda for the September 7th Coordination Committee meeting of the San Juan Recovery Implementation Program ["San Juan RIP"]: "Discussion and approval of a proposal for the San Juan RIP Coordination Committee to request the Fish and Wildlife Service to conduct a programmatic consultation on the development of 60,000 acre feet of new depletions from the San Juan River Basin over and above the baseline that would be established pursuant to the January 2007 Navajo Gallup Water Supply Project Biological Opinion." In order to determine the State of New Mexico's interest and involvement in the initiation of "a programmatic consultation" on the development of such a large quantity of new water depletions from the San Juan River (60,000 acre-feet would be sufficient water, for example, to cool as many as 15 coal-fired power plants as large as the proposed Desert Rock Energy Project), I request an opportunity to inspect the following records: -- any and all documents (including both hard copy and electronic communication) related to the August 8th request by the State of New Mexico for the San Juan RIP Coordination Committee to formally request that the United States Fish & Wildlife Service conduct a programmatic consultation on the development of 60,000 acre-feet of new depletions from the San Juan River over and above the environmental baseline that would be established pursuant to the January 2007 Navajo-Gallup Water Supply Project Biological Opinion

CORA Request to COAG RE: Long Hollow Reservoir

Our request under CORA is twofold, but narrow. The first prong of this request relates specifically to any and all documents associated with efforts by the State of New Mexico and the Navajo Nation [Tribe] to settle the Tribe's outstanding water rights in the San Juan River Basin. On 5 December 2003 the State of New Mexico released a discussion draft document as a proposal intended to reach settlement of the Navajo Nation's water rights claims on the San Juan River. On 9 July 2004 a revised draft of this proposed settlement was released by the State of New Mexico. Various entities and agencies have submitted comments on these drafts. CPA requests an opportunity to examine any documents to or from the COAGO regarding these draft proposals for the settlement of the Navajo Nation's water rights claims in the San Juan River Basin. The second prong of this request relates to the subject of an application for a permit to build a Long Hollow Reservoir, submitted to the U.S. Army Corps of Engineers [USACE] by the La Plata Water Conservation District [LPWCD]. CPA requests an opportunity to examine any documents to or from the COAGO regarding the application by the LPWCD to the USACE for a permit to build a Long Hollow Reservoir.

Request for Public Records -- New Mexico State Engineer

Not withstanding recent public comments to the contrary by your attorney D.L. Sanders, for some twenty-three months now the State of New Mexico ["State"] has participated in the Navajo-San Juan River Federal Indian Water Rights Negotiation ["Negotiation"] with the Navajo Nation ["Tribe"] and the Navajo-San Juan River Federal Indian Water Rights Negotiation Team ["Team"], formally seeking to craft a settlement of the Tribe's claims to water from the San Juan River in New Mexico.  During that time, despite numerous requests, no other entities, groups, parties of interest or individuals have been permitted to attend or participate in the Negotiation.
